PICK UP & DELIVERY – Blok Design Co. shall be responsible for all costs associated with pick-up and delivery and returns of the Hire Furniture.
RENTAL FEE – The Renter shall pay the Rental Fee in full prior to the delivery of the Hire Furniture to the Place of Installation.
CANCELLATION – The Renter may cancel any order at any time prior to delivery of the Hire Furniture to the Place of Installation, subject to the Renter paying the following:
- 50% of the Rental Fee if notice of the cancellation is provided to Blok Design Co. more than 24 hours but less than 5 business days to delivery of the Furniture to the Place of Installation or
- 100% of the Rental Fee if notice of the cancellation is provided to Blok Design Co. less than 24 hours prior to the delivery of the Hire Furniture to the Place of Installation.
TERM OF RENTAL The Rental Period is the minimum term as set out in the agreement and no refund will be made for early return of the Hire Furniture.
EXTENSION – Subject to Blok Design Co’s sole discretion and on receipt of the Extension Rate as specified in the attached Schedule by the Renter, the Rental Period may be extended for a period agreed by Blok Design Co.
LOCATION – the Renter shall not allow any of the Hire Furniture to be removed from the Place of Installation unless authorized in writing by Blok Design Co.
TITLE – The Renter acknowledges the title to the Hire Furniture remains with Blok Design Co. who shall have the right to immediate possession upon breach of any of the Terms of this Agreement by the Renter. For this purpose, the Renter agrees that Blok Design Co. may at any time enter any premises where it is reasonably believed the Hire Furniture is, for the purpose of taking possession of the Hire Furniture. The Renter shall not assign, pledge, mortgage, lend, let hire or part with possession of any of the Hire Furniture. The Renter is responsible for ensuring that the Hire Furniture is excluded from any contracts issued in relation to the sale or rental of their property.
DAMAGE, LOSS, THEFT or DESTRUCTION – The Renter shall keep the Hire Furniture in good repair and condition and shall not make any alterations, repairs or additions to the Hire Furniture. In the event the Hire Furniture is damaged, lost, stolen or destroyed, regardless of whether the Renter caused or contributed to such damage, loss, theft or destruction, the Renter agrees to compensate Blok Design Co. by paying the Replacement Cost of the Hire Furniture as specified in the attached Schedule.
WARRANTIES – The Renter acknowledges that Blok Design Co. is not the manufacturer of the Hire Furniture and that Blok Design Co. gives no warranty as to the fitness of the Hire Furniture for any particular purpose or that it is of a particular quality. The Renter must rely upon his or her own inspection of the Hire Furniture.
DEFAULT – In default of compliance by the Renter with any of the provisions of this Agreement then at the option of Blok Design Co. this Agreement shall be deemed to be determined and the Renter thereafter shall pay all moneys due under this Agreement plus all incurred legal costs in effecting recovery of moneys due by the Renter pursuant to this Agreement.
NOTICES – Any Notices may be served by one party on the other personally or by pre-paid post or by fax at the parties address as shown in this Agreement or as in the case of the Renter at the Installation Address.
INDEMNITY – The Renter agrees to indemnify Blok Design Co. for all liability, claims, damage, loses, and legal costs in respect of: personal injury; damage to property; a claim by a third party; incurred by Blok Design Co. arising directly or indirectly as a result of or in connection with the Renters rental of the Hire Furniture or breach of this Agreement.
INTERPRETATION – It is agreed that the Law of the State of Queensland shall govern this Agreement.
DIRECTORS GUARANTEE – In the event that the Renter is a company then the terms and conditions of this Agreement on the part of the Renter are hereby unconditionally guaranteed, as testified by their execution hereof, by such of the Renter’s directors whose names and addresses appear on the invoice provided by Blok Design Co.
